General Contracting Terms

1. Privacy Policy

1.1. DANEX UMAG guarantees that it will respect the Privacy of all its customers, and that it will neither transfer any information to a third party, nor misuse the information for marketing purposes, without prior authorization.

1.2. DANEX UMAG only collects information required for the reservation process. All information is kept confidential and is only available to those employees, who require the information to complete their job duties.

1.3. All employees and business partners of DANEX UMAG are responsible for upholding the principles of the Privacy Policy.


2. Inquiries, Booking and Payment

2.1. Inquiries, Booking and Payment of the accommodation may be done electronically (per e-mail or fax), or also in person at the DANEX UMAG office, as well as at the DANEX UMAG partner agencies.

2.2. If you pay by credit card, it will be charged to the amount stated in KUNA. Note that total sum may slightly differ from the original, with regard to the exchange rates EURO / KUNA (max. 2-3%).

2.3. When booking, the customers confirm that they are familiar with the General Contracting Terms, and that they accept them in their entirety.

2.4. Thus, everything stated in the General Contracting Terms becomes legally binding for all, the customers and DANEX UMAG.


3. Accommodation Price

3.1. The Accommodation Price includes the basic service, as described in the booked accommodation unit, and it is given in EURO / KUNA.

3.2. DANEX UMAG reserves the right to make changes to the stated prices (in the event that the host changes prices).

3.3. For customers who have already settled a prepayment for their reservation, DANEX UMAG guarantees the Accommodation Price stated in the calculation, according to which the prepayment was settled.

3.4. If the changes occur prior to the settlement of the prepayment, DANEX UMAG is required to inform the customers immediately.

3.5. If more customers than stated on the voucher arrive at the accommodation unit, the host has the right to deny the extra customers accommodation, or to accommodate all of the customers at extra charge, directly made to the host.


4. Resident Tax

4.1. According to the Croatian Law, customers are required to pay the Resident Tax, when paying for their accommodation.

4.2. The Resident Tax in the Republic of Croatia varies from 0.50 EURO to 1.00 EURO per person and day, while children under the age of 12 are exempt from paying.

4.3. The final amount of the Resident Tax is determined by the destination in the Republic of Croatia and travel period, and is charged according to the General Contracting Terms, when balance payment is made.


5. Categorization and Service Description

5.1. The accommodation units offered by DANEX UMAG are described in accordance to the Official Categorization of the Authorized Institution, and based on onsite assessment, prior to being put in DANEX UMAG online offer.

5.2. Standards for accommodation, food, services, etc. differ from place to place, country to country, and cannot be compared.

5.3. Information obtained at the point of sale does not oblige DANEX UMAG in any way more than any information available on the Website www.croatia-danexumag.com, in the DANEX UMAG catalog, or other printed material.


6. Changes, Modifications and Cancellations

6.1. DANEX UMAG reserves the right to Change or Modify a reservation, in case of circumstances caused by conditions beyond its control, that cannot be predicted, avoided or rectified.

6.2. The booked accommodation can be substituted only by an accommodation unit of the same or higher category, and at the price confirmed during the booking, provided that customers are notified ahead of time.

6.3. In cases where substitute accommodation for paid accommodation is not available, DANEX UMAG reserves the right to Cancel the reservation, upon prior customers' notification (at least 7 days before arrival) and guarantees the immediate refund of the complete amount paid.

6.4. Should the customers wish to Change, Modify or Cancel a reservation, this must be done in written form (per e-mail or fax), at least 7 days prior to the arrival date.


7. Agency's and Customers' Obligations

7.1. DANEX UMAG has the Obligation to take care of the provided services, hosts, and customers' interests and rights, according to accepted customs and practices in tourism.

7.2. DANEX UMAG will carry out all stated Obligations in full and as described above, except in circumstances caused by conditions beyond its control.

7.3. The customers are required to have valid travel documents, to obey Croatian customs regulations and currency exchange regulations, to obey house rules in accommodation units and to have good relations with the host, to produce the confirmation of payment (Voucher received by e-mail or fax) upon arrival.

7.4. The customers are also obligated to check whether a visa is necessary for the country where the destination is located, or for neighboring countries.

7.5. Should the customers not follow the above listed Obligations, the customers are liable for caused damage and must cover the expenses.

7.6. By confirming the reservation, the customers accept to pay for all damages caused directly to the host.


8. Luggage, Valuables and Other Goods

8.1. DANEX UMAG is not responsible for damaged, destroyed or lost Luggage, as well as for the theft of Luggage or Valuables in the accommodation unit (rental of a safety deposit box is recommended if available).

8.2. Lost Luggage or stolen Other Goods should be reported to the host and the local police department.


9. Customers' Complaints

9.1. Should the services provided not be satisfactory, the customers are entitled to seek reasonable compensation by filing a written Complaint. All customers are entitled to file a Complaint if the paid service is not provided.

9.2. The customers are required to complain to the service provider about the inadequate service immediately on the arrival day, and to notify DANEX UMAG office in Umag, by e-mail complaint@croatia-danexumag.com, by phone +385 52 742 699, or by fax +385 52 742 910.

9.3. DANEX UMAG is required immediately to send the regional representative on the spot, while the customers are required to wait for him/her in the accommodation in question.

9.4. Furthermore, the customers are required to cooperate with DANEX UMAG representatives and the service provider in good faith, in order to rectify the problem.

9.5. If the customers refuse to accept the solution that is in accordance with services paid for, DANEX UMAG is not required to accept any further Complaints referring to this service (if there is an appropriate alternative in the same accommodation building, the customers are required to accept it).

9.6. DANEX UMAG does not accept claims related to elements that are not part of the accommodation (such as construction work on roads, state of the beach and buildings in the immediate vicinity, etc.).

9.7. Also, DANEX UMAG cannot be responsible for the weather conditions, the cleanliness and temperature of the sea of destinations visited, as well as all other similar situations and events not directly related to the quality of the reserved accommodation unit, that can result in the dissatisfaction of the customers.

9.8. The eventual compensation owed by DANEX UMAG for clients' complaints cannot, in any case, exceed the cost of the service complained, and it cannot include services already provided nor exceed the total price of stay.


10. Force Majeure

10.1. DANEX UMAG provides accommodation services in accordance with the General Contracting Terms, and with the period and details of the confirmed reservation. DANEX UMAG is not liable for Force Majeure (such as wars, catastrophes, epidemics, strikes and similar).


11. Court Jurisdiction

11.1 Should the customers not be satisfied with the solution to the complaint, the matter may can be taken to court (Umag Court jurisdiction).
